Amazon hit with second $1 billion-plus UK competition claim

Geradin Partners Files the Claim on Behalf of Third-Party Online Sellers

Geradin Partners, a Brussels-based law firm, has initiated proceedings against Amazon at the Competition Appeal Tribunal in the UK. The legal claim, which is being brought on behalf of more than 200,000 third-party online sellers, is estimated to amount to £2.7 billion ($3.41 billion) in damages. The claimant, a UK-based law professor, argues that Amazon has discriminated against third-party sellers and towards leveraging its own retail offers and logistics services, known as Fulfilment by Amazon. Innsworth, a third-party litigation funder, is financing the case of Andreas Stephan, a professor of competition law at the University of East Anglia.

The claim includes sellers who will remain anonymous unless they opt-out. Geradin’s founding partner, Damien Geradin, confirms that the number of sellers involved is likely to rise beyond 200,000 pending disclosure. In its response, Amazon distanced itself from the allegations labelling them as “baseless”. The company pointed out that its success is premised on the performance of businesses selling through their platform and that over 100,000 small and medium-sized businesses use Amazon’s store in the UK. More than 50% of physical product sales on its UK store are by independent selling partners.

Geradin Partners’ Track Record Against US Tech Giants

Geradin Partners is a Belgian law firm with a history of initiating class-action suits against US tech giants. The law firm previously filed multi-billion-pound claims that sought to recover damages against Google for its misuse of advertising technology in the Netherlands and the UK in 2022. Amazon is currently facing another claim in the UK for £1 billion for “illegally misusing” data and “manipulating the Amazon Buy Box” filed by British Independent Retailers Association, which is being advised by Willkie Farr & Gallagher.
